Terms & Conditions

Effective date: 07 October 2026

These Terms & Conditions govern your use of the websites, landing pages, forms, booking pages and other online services operated by David Pham trading as Simple Growth Group (“Simple Growth Group”, “SGG”, “we”, “us” or “our”).

By accessing or using our websites, submitting an enquiry or booking a strategy session, you agree to these Terms & Conditions to the extent applicable to your interaction with us.

These Terms apply to simplegrowthgroup.com.au, go.simplegrowthgroup.com.au and related Simple Growth Group pages, forms and booking systems.

If you become a paying client, your services will also be governed by a separate proposal, service agreement, order form or other written agreement. If there is an inconsistency, the signed client agreement will govern the provision of paid services to the extent of that inconsistency, subject to applicable law.

About Simple Growth Group

Simple Growth Group provides business-to-business marketing and advertising services, including advertising strategy, campaign management, lead generation, automated follow-up, lead qualification and appointment-booking systems.

Our services are primarily intended for established Australian businesses, including mortgage brokers and related professional service providers.

Unless expressly stated otherwise, information on our websites is general information only.

Website use

You may use our websites for lawful business and informational purposes.

You must not:

use our websites for unlawful, fraudulent or misleading purposes;

interfere with, damage, disable or attempt to gain unauthorised access to our websites, systems or accounts;

introduce malicious code, viruses, automated scraping tools or other harmful technology;

copy, reproduce or commercially exploit website content except as permitted by law or with our written consent;

impersonate another person or business;

submit information that you know is false, misleading or unauthorised; or

use our websites in a way that infringes another person's rights.

We may restrict access to our websites where reasonably necessary to protect our business, users, systems or legal rights.

Information on our website

We take reasonable care to keep information on our websites current and accurate. However, website content is provided for general information and may change as our services, offers, technology or business practices evolve.

Information on our websites does not constitute a promise that a particular strategy, campaign, platform or service will be suitable for every business.

You should consider your own circumstances and obtain appropriate professional advice where required before making business, financial or legal decisions.

No financial, credit, legal or tax advice

Simple Growth Group is a marketing and advertising business.

Unless expressly stated otherwise, we do not provide:

financial product advice;

credit assistance or recommendations concerning particular credit products;

mortgage or lending advice to consumers;

legal advice;

taxation advice; or

accounting advice.

References to mortgage brokers, borrowers, lending markets, enquiries, appointments or advertising performance are made in the context of our marketing services.

Mortgage brokers and other regulated professionals remain responsible for providing their own professional services, advice, disclosures and regulatory compliance.

Strategy sessions and enquiries

Submitting an enquiry or booking a strategy session does not automatically create a client relationship or require either party to proceed with services.

We may use information provided through our forms to:

assess whether our services appear suitable for your business;

understand your current marketing activities and objectives;

determine campaign capacity, service-area availability or other eligibility requirements;

prepare for a strategy discussion; and

contact you regarding your enquiry or appointment.

We may decline an enquiry or proposed engagement where we reasonably determine that our services are not suitable, capacity is unavailable, there is a conflict of interest, or we are unable to provide the requested service.

Any stated limit on the number of new brokerage campaigns we onboard, including references to a maximum number of new campaigns per month, reflects our current operational capacity and may be subject to service-area availability. A strategy-session booking or enquiry does not reserve campaign capacity or guarantee acceptance as a client.

Appointment bookings

Where you book a call or strategy session, you are responsible for providing accurate contact and scheduling information.

Appointment availability is not guaranteed until the booking is confirmed.

We may reasonably reschedule or cancel an appointment where required due to availability, technical issues, illness or other operational circumstances. Where practicable, we will provide reasonable notice and offer an alternative time.

If you are unable to attend, we ask that you reschedule or cancel using the booking link or contact us as soon as reasonably possible.

Services and client agreements

Detailed terms governing paid services—including scope, fees, advertising spend, payment arrangements, campaign responsibilities, qualification criteria, term, termination and any applicable guarantee—will be set out in a separate written agreement provided before or when you engage us.

Any website offer, guarantee, illustrative pipeline value, campaign-capacity statement or service-area availability statement is subject to the applicable written client agreement and does not, by itself, create an entitlement to services, campaign capacity, exclusivity or a particular result.

A website enquiry, strategy session or proposal does not require Simple Growth Group to commence services until any required agreement has been accepted and applicable onboarding requirements have been completed.

Advertising and performance results

Marketing and advertising results can be affected by factors outside our control, including:

advertising budget;

geographic market;

competition;

offer strength;

pricing;

business reputation;

lead response times;

sales processes;

client availability;

advertising-platform performance and policy changes;

seasonality;

economic and lending conditions; and

the quality and accuracy of information supplied by the client.

Past performance, examples, projections, testimonials or case studies do not guarantee that another business will achieve the same results.

Except where an express written guarantee applies to an eligible campaign, we do not guarantee any particular number of leads, appointments, applications, loan approvals, settlements, lending volume, clients, commissions, revenue, profit or return on advertising spend. References to potential lending opportunity or pipeline value are illustrative unless expressly stated otherwise in a written client agreement.

Campaign Targets and Commercial Arrangements

Campaign objectives and performance targets

Simple Growth Group may advertise campaign objectives, including a target of 30 or more Attended, Qualified Mortgage Appointments over a 90-day period.

Such statements describe intended objectives for suitable, eligible campaigns. They do not constitute an unconditional guarantee, a representation of historical results achieved by Simple Growth Group, or a promise that every brokerage will achieve the stated target.

Before commencement, Simple Growth Group and the client will assess and agree on an appropriate campaign objective, taking into account the client's advertising budget, servicing capacity, geographic market, borrower demand, qualification criteria, campaign structure and other relevant circumstances.

The target applicable to a particular engagement, if any, will be recorded in the signed client agreement.

Appointment definition and measurement

An Attended, Qualified Mortgage Appointment means an appointment with a new, non-duplicate prospective borrower attributable to the agreed campaign who:

  1. Meets the brokerage's agreed qualification criteria.

  2. Demonstrates genuine lending-related intent within the agreed timeframe.

  3. Meets the applicable service-area and contact requirements.

  4. Books and attends an appointment with the brokerage.

Cancelled appointments, no-shows, duplicate enquiries and appointments that do not satisfy the agreed qualification criteria are excluded from the attended, qualified appointment count.

The client agreement will specify the campaign commencement date, measurement period, attribution methodology and appointment-verification procedure.

Performance conditions and client responsibilities

Campaign outcomes depend on multiple factors, including advertising investment, market conditions, borrower behaviour, campaign performance, client availability and timely client cooperation.

Clients must fulfil the responsibilities specified in their agreements, including maintaining agreed advertising investment, providing necessary access and approvals, making appointments available and recording relevant outcomes.

Simple Growth Group will perform its agreed services in accordance with its contractual obligations and applicable law.

Targets and guarantees

Unless an express performance guarantee is included in the signed client agreement, campaign objectives are not guaranteed delivery commitments.

Where a guarantee is expressly agreed, its scope, eligibility requirements, measurement rules, exclusions and remedy must be documented in that agreement.

Achievement of a campaign objective does not guarantee loan applications, approvals, settlements, lending volume, commissions, revenue, profitability or return on advertising investment.

Nothing in this section excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under applicable Australian law.

Commercial arrangements

Engagements may operate under fixed-fee, hybrid, performance-based, co-funded, commission-based or other agreed commercial structures.

The signed client agreement will specify fees, media funding, applicable performance charges, campaign objectives and any agreed remedies. Certain arrangements may require additional regulatory or licensing approval before implementation.

Client responsibilities

Where you engage our services, campaign performance may depend on your cooperation.

Depending on the agreed service, you may be required to:

provide accurate business, service and offer information;

provide required advertising assets, approvals and account access;

maintain sufficient advertising budget;

respond to enquiries and appointments within agreed timeframes;

maintain availability for booked appointments;

reasonably cooperate in recording appointment outcomes and promptly notify us of any alleged duplicate or non-qualifying appointment in accordance with the applicable client agreement;

accurately communicate licensing, accreditation and regulatory information;

comply with applicable industry and advertising requirements; and

promptly notify us of changes that may affect a campaign.

Detailed client responsibilities will be set out in the applicable service agreement.

Third-party advertising and technology platforms

Our websites and services may use or integrate with third-party providers such as HighLevel/GoHighLevel, Meta, Google, Microsoft 365, Microsoft Teams, Mailgun, telecommunications providers, domain and hosting providers, analytics services and other software platforms.

These providers operate independently and may change their:

systems;

functionality;

pricing;

policies;

advertising rules;

algorithms;

availability; or

terms of service.

We do not control third-party platforms and cannot guarantee their uninterrupted availability or continued functionality.

Where a service disruption or platform change is outside our reasonable control, we will take reasonable steps appropriate to the circumstances to minimise disruption to services we provide.

Advertising account compliance

Clients are responsible for ensuring that information, claims, licences, disclosures, offers, products and services supplied to us for advertising are lawful, accurate and not misleading.

We may refuse, pause or amend campaign material where we reasonably believe that it may breach:

applicable law;

advertising-platform policies;

industry requirements;

third-party rights; or

reasonable compliance standards.

Approval of advertising material by Simple Growth Group does not constitute legal or regulatory advice.

Intellectual property

Unless otherwise stated, the content on our websites—including text, branding, logos, graphics, designs, layouts, videos, marketing frameworks and other materials—is owned by or licensed to Simple Growth Group and is protected by applicable intellectual-property laws.

You may view and use our website content for your own legitimate business evaluation.

You must not reproduce, distribute, modify, sell, publish, commercially exploit or represent our content as your own without our prior written permission, except where permitted by law.

Simple Growth Group, associated branding and the Simple Growth System may not be used in a manner that suggests sponsorship, endorsement or affiliation without our written consent.

Information and materials you provide

If you submit information, copy, images, logos, testimonials, campaign material or other content to us, you represent that:

you have authority to provide it;

its use for the relevant purpose will not infringe another person's rights; and

to the best of your knowledge, material factual claims you provide are accurate and not misleading.

Where you engage our services, you grant us the permissions reasonably required to use supplied materials solely for providing, administering and improving those services, subject to the applicable client agreement and Privacy Policy.

Testimonials and case studies

Testimonials, case studies and examples displayed on our websites represent particular experiences and circumstances.

Individual outcomes vary.

We will not knowingly publish a testimonial or performance claim that we believe materially misrepresents the relevant experience or result.

A testimonial or case study should not be interpreted as a guarantee that you will achieve the same or similar result.

Third-party links

Our websites may contain links to third-party websites, platforms or resources.

A link does not necessarily mean that Simple Growth Group endorses, controls or accepts responsibility for the third party.

Third-party websites are governed by their own terms, privacy practices and security arrangements. You should review those terms before providing information or using their services.

Privacy

We handle personal information in accordance with our Privacy Policy and applicable law.

Our Privacy Policy explains how we may collect, hold, use and disclose personal information, including information submitted through forms, booking systems, email, SMS, telephone calls and related communications.

Our Privacy Policy is available at:

https://go.simplegrowthgroup.com.au/privacy-policy

Electronic communications

By submitting an enquiry or booking an appointment, you consent to receiving communications reasonably necessary to respond to your enquiry, administer your appointment or provide a service you have requested.

Marketing communications are handled in accordance with applicable law and our Privacy Policy.

Where an unsubscribe facility is provided, you may use it to opt out of marketing communications. Opting out of marketing does not prevent us from sending necessary non-marketing communications relating to an active enquiry, appointment or service.

Website availability and security

We take reasonable steps to maintain our websites and systems, but we do not guarantee that they will always operate without interruption, delay or error.

Access may occasionally be affected by:

maintenance;

hosting issues;

internet or telecommunications outages;

third-party provider failures;

cybersecurity events; or

circumstances outside our reasonable control.

You are responsible for maintaining appropriate security for your own devices, accounts, passwords and systems.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law where doing so would be unlawful.

Where rights or remedies cannot lawfully be excluded, these Terms operate subject to those rights and remedies.

Limitation of liability

To the maximum extent permitted by law, Simple Growth Group is not responsible for loss arising solely from:

decisions you make without obtaining appropriate professional advice;

inaccurate, incomplete or misleading information supplied by you or another third party;

acts or omissions of third-party platforms or providers outside our reasonable control;

unauthorised use of your accounts or systems not caused by our failure to exercise reasonable care;

your failure to comply with applicable laws, industry obligations or platform policies; or

circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited, including applicable rights under the Australian Consumer Law.

Any additional allocation or limitation of liability relating to paid client services will be set out in the applicable client agreement and will operate only to the extent permitted by law.

Indemnity

To the extent permitted by law, you are responsible for loss, liability or reasonable costs suffered by Simple Growth Group arising directly from:

your unlawful use of our websites or services;

material supplied by you that infringes another person's rights;

materially false or misleading information knowingly provided by you; or

your material breach of these Terms,

except to the extent that the loss was caused or contributed to by Simple Growth Group.

Nothing in this clause limits any rights or protections that cannot lawfully be excluded.

Changes to these Terms

We may update these Terms to reflect changes to our websites, services, technology, providers or legal obligations.

The current version will be published on our website with an updated effective date.

Changes will apply prospectively from the updated effective date unless applicable law requires otherwise.

Material changes relating to an existing paid service will be handled in accordance with the applicable client agreement and law.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the minimum extent necessary.

The remaining provisions will continue to operate to the extent permitted by law.

No waiver

If we do not immediately exercise a right under these Terms, this does not necessarily mean that we have waived that right.

Any waiver must be clear and will apply only to the particular circumstances for which it is given.

Governing law

These Terms are governed by the laws of New South Wales, Australia.

You and Simple Growth Group submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them.

Nothing in this clause limits any right you may have under applicable Australian law to bring a claim in another jurisdiction where that right cannot lawfully be excluded.
